A Umatilla man has been arrested on a Lake County warrant charging him with repeated incidents in which he inappropriately touched a young girl.
Devin Manuel Delgado, 20, was taken in by the Lake County Sheriff’s Office for battering a female juvenile victim for an indeterminate amount of time before she went to the police earlier this year.
On Feb. 17, road patrol with the Lake County Sheriff’s Office received a report that a female juvenile victim told her father that she was touched inappropriately, according to an affidavit of probable cause out of Lake County.
In the initial report regarding disclosure by the juvenile victim, she stated that she was being victimized by Delgado. She explained that he had been undressing her, pinning her down and touching her on her “girl parts” to mean her chest and genital areas. When asked the last time Delgado touched her, she stated the night before. He had undressed her and touched her “girl parts.” She advised that he placed his “boy parts” in her mouth for about two minutes, the affidavit said.
The juvenile victim stated that Delgado had to fight her and pin her down because she fights him every time. Furthermore, he had been pinning her down and touching her inappropriately for an undisclosed amount of time prior to this incident. Her grandmother, aunt and her mother had watched Delgado touch her inappropriately, and she had been told by them to “suck it up and deal with it,” the affidavit said.
The juvenile victim advised that she spent a lot of time at the address in which Delgado touched her inappropriately almost every time that she was there. He always got undressed and tried to undress her, but she fought him. Most of the incidents took place in his bedroom. He told her, “I will get you pregnant one way or another,” the affidavit said.
The grandmother of the juvenile victim stated that there was an inappropriate incident that occurred many years ago, initially claiming not to recall the details. She later told a detective that she remembered walking into a bedroom where Delgado briefly took the juvenile victim to see her lying on her back with her legs in the air and her pants undone. Delgado was standing beside the juvenile victim when this happened, but she recalled his pants being on at the time, the affidavit said.
This was reported to Delgado’s mother who advised that she recalled being told the juvenile victim and Delgado exposed themselves to each other years ago. Due to this incident, Delgado and the juvenile victim were not allowed to be alone together. She also stated that Delgado had the mindset of a 15-year-old at the time of the interview due to being developmentally delayed, though medical paperwork was not provided, the affidavit said.
The juvenile victim also participated in a forensic interview. She reiterated that she was touched inappropriately by Delgado and taken to the Umatilla Police Department due to this. He tried to get her clothes off “and stuff” “more than one time,” the affidavit said.
The juvenile victim also recalled one occasion in which she was on the couch at the residence when Delgado approached her. He began to touch her inappropriately, first on top of her clothes and then attempting underneath, and told her to stay quiet as he did so. She tried to move away and call for her aunt, but Delgado told her to shut up, the affidavit said.
This occurred the Saturday before the juvenile victim was Baker Acted. After the incident, she was taken to the police department because something unrelated was happening with her mother at the same time. The police told the juvenile victim that she could not go back to her father’s and would have to go to her mother’s. She then told police she wanted to kill herself, the affidavit said.
The first time something happened was at a prior undisclosed age. The juvenile victim told her mother what occurred which was when she was told to “suck it up and deal with it.” When asked what happened when she was young, she stated she did not remember, the affidavit said.
However, the juvenile victim recalled one incident where Delgado’s “boy parts” went inside her “down there” and her mouth. She clarified that this happened the same night she was on the couch. Delgado grabbed her hand and “dragged her” into the bedroom by her arm. He then threw her onto the bed and tried to take off her pants while holding her arms and legs down, but she fought to get them back up before leaving the room. She could not remember when his part went inside her, the affidavit said.
When the juvenile victim left the room, she told her grandmother, but she did not care. She told her father what happened a week before the forensic interview. The night prior to being Baker Acted, she sent her father messages about what happened, the affidavit said.
The forensic report was later obtained and indicated positive findings for sexual molestation, sexual battery, physical abuse and failure to protect. The physical abuse was regarding the juvenile victim’s disclosure of her mother and grandmother hitting her. There were concerns of parental influence on the father’s part in the report, the affidavit said.
Delgado participated in a non-custodial interview with detectives outside the front door of the residence. He initially denied all allegations. He mentioned multiple times throughout the interview that he had mental issues, however he was qualified, knowing the difference between a truth and a lie, the affidavit said.
Delgado eventually stated that he and the juvenile victim were in his room while others were in the house, and the juvenile victim began making advances on him. He claimed that she touched his private area with only her hands as he tried to reject her advances. He later advised that she touched his penis and put it in her mouth, the report said.
This lasted for a short amount of time before Delgado stopped her due to knowing that they should not do that. He also advised that five to six years prior to the interview, he had “sex” with the juvenile, the report said.
Delgado was ultimately arrested Thursday morning on charge of lewd and lascivious battery. He was transported to Lake County Jail with bond set at $25,000.
