A Leesburg woman has been arrested as the third suspect in the 2024 fatal shooting of an elderly man at a Citgo gas station.

On Thursday, the Leesburg Police Department successfully found and arrested the third suspect in connection with the Sept. 28, 2024, shooting at the Citgo gas station, located at 2101 W Main St., Leesburg.

Jasmine Tynise Gainey, 21, was taken into custody following a relentless investigation by Leesburg police detectives, to find the latest suspect in the death of 87-year-old Clarence Ervin. Gainey has been charged with first-degree premeditated homicide and aggravated battery with a firearm on a victim over the age of 65.

On the afternoon of Sept. 28, 2024, the LPD responded to the shooting at Citgo. Upon arrival, they learned three suspects had approached a vehicle. Two suspects remained at the passenger side while one approached Ervin, who was seated inside. A confrontation ensued, resulting in Ervin being shot. 

The suspects fled the scene on foot. Officers administered first aid to Ervin, who was subsequently taken to the hospital and underwent surgery that night. However, on Oct. 6, detectives were notified that he passed away from his injuries.  

Following Ervin’s death, 22-year-old Kenneth Dalon Bailey of Leesburg and 22-year-old Craig Anthony Stevenson Jr. of Leesburg were both arrested on the evening of  Oct. 11, and charged with capital murder and aggravated battery (firearm) on a person over 65. Bailey was ultimately sentenced to 45 years after being found guilty of murder in March. 

Additionally, Gainey has been arrested several times in the past. She stole $50 off a vape shop counter in January, had a violent confrontation with a customer in a Wendy’s drive-thru in December 2024, and brawled behind the counter with another employee at McDonald’s in May 2022.
