Leesburg man arrested after allegedly pushing woman to ground during argument

A Leesburg man was arrested for battery after allegedly pushing a woman to the ground during an argument in their home.

Police responded to an undisclosed Leesburg residence concerning a battery complaint involving 33-year-old Sean Allan Diaz around 1:00 p.m. on Thursday, Dec. 21, according to an arrest report from the Leesburg Police Department. 

Upon arrival, an officer spoke with the female victim in the front door breezeway of the residence. She explained that an argument took place the night before that led to other LPD Road Patrol officers responding to the home. Diaz had allegedly pushed her and caused her to fear for the safety of herself and her children, the report said. 

The victim stated that after officers cleared the scene, she intended to collect her medication from the bathroom inside the residence. However, Diaz locked her out of the room attached to the bathroom. After another argument, the victim stated that Diaz opened the bedroom door, threw her medication into the common area and forcefully pushed both her shoulders with open hands causing her to fall onto the floor, the report said. 

The victim continued to explain that both her children witnessed the incident. During separate conversations with them, their verbal testimony corroborated the victim’s, the report said. 

Although the officer did not notice any visible injuries the victim sustained from the battery, she informed the officer that she was having pain in her lower back from falling onto her buttocks when Diaz pushed her, the report said. 

Once the on-scene investigation was completed, an attempt to contact Diaz at his job in Leesburg did not lead to his arrest. The officer instead spoke to him over the phone. Per their conversation, Diaz agreed to respond to the police department and talk about the incident, the report said. 

At about 3:07 p.m., Diaz arrived at the police department. He stated that after the argument that led to a police response, the victim went back inside while he remained in the garage listening to music until about midnight. He then went back inside and claimed to have stayed in a separate bedroom from the victim, the report said. 

Diaz advised that the victim came to the room to request her medication at some point during the night. With her children present, they both entered the room, he helped the victim with collecting her medication and come unspecified personal property, and they stayed in separate rooms for the rest of the night, the report said. 

Diaz denied any physical altercation taking place and insisted that the allegation was fabricated. He claimed that one of the children lied on the victim’s behalf because she allows him to smoke marijuana with her, the report said. 

Upon conclusion of the interview, Diaz was arrested on charge of simple battery (domestic). He was transported to the Lake County Jail with bond set at $1,000.
