Man with medical marijuana card admits to putting street pot into prescription containers

An Ocala man was arrested for possession of marijuana even though he had a medical marijuana card.

Devin Gene Preston, 26, had been driving a Lincoln SUV on U.S. Hwy. 441 near Radio Road in Leesburg when a police officer noticed he wasn’t wearing a seatbelt.

During a traffic stop, the officer detected the odor of marijuana coming from the Lincoln when Preston rolled down his window, according to an arrest report from the Leesburg Police Department. He presented the officer with a valid medical marijuana card.

The officer saw a baggie which contained a green leafy substance in plain view in the car. When the officer asked why the substance which Preston admitted was marijuana was not in the proper prescription containers Preston said “he would buy the cheaper marijuana off of the street and place it into the prescription containers.” However, he apparently failed to make the transfer prior to the traffic stop.

Preston was arrested on a charge of possession of more than 20 grams of marijuana. After processing at the Leesburg Police Department Preston was taken to the Lake County Jail with bond set at $2,000.
