Woman tells officers search is ‘BS’ when stopped for not wearing seatbelt

A Eustis woman was arrested after officers found THC wax in her vehicle when she was stopped for not wearing a seatbelt.

An officer observed a maroon van heading northbound on Grove Street with a female driver, later identified as 24-year-old Katie Nicole Kist, not wearing her seatbelt around 8:22 a.m. Thursday, according to an arrest report from the Eustis Police Department. He had a clear view of Kist due to no tint being on the driver’s window. He also observed the seatbelt to be resting in its mounting location.

The officer activated his emergency lights and initiated a traffic stop on County Road 452 and County Road 19A. Upon approaching Kist, identified by her driver’s license, the officer introduced himself and explained the reason for the stop, the report said. 

Kist told the officer that she was wearing her seatbelt. He informed her that he had a clear view of her in the vehicle not wearing her seatbelt from where his patrol vehicle was parked. After handing over her vehicle documents, she admitted to not putting her seatbelt on until after she passed the red light on Grove Street and Orange Avenue because she had just left her house and did not realize she did not have it on, the report said. 

Due to the odor of burnt marijuana coming from the vehicle, the officer asked Kist if she had a medical marijuana card, and she told him no. The officer went back to his car and called for another unit, the report said. 

After another officer arrived, both officers approached the vehicle to advise Kist that they would be searching it because of the burnt marijuana smell, the report said. One of the officers asked her to step out of the vehicle so they could conduct the search. She got upset, saying, “This is BS.” 

When Kist got out of the vehicle, she snatched her purse and walked toward the road where there was traffic, the report said. She was then detained for her safety and officer safety. She spontaneously uttered, “And imma just let you know you’re gonna find wax.” 

One of the officers was able to calm Kist down and read her rights, which she advised she understood and would speak with him. She stated there was just wax in the car, and she smoked in her vehicle the day before. This was where the smell came from, the report said. 

Upon searching the vehicle, the officers found two containers of THC wax, one yellow and other black, inside a black and yellow backpack on the front driver’s seat. Both containers tested positive for THC. Kist admitted the backpack was hers, the report said. 

Kist was subsequently arrested on charge of possession of THC wax and issued a citation for not wearing her seatbelt. She was transported to Lake County Jail and released after posting $2,500 bond.
