A Leesburg man was arrested for driving under the influence during a domestic battery investigation.

A deputy responded to a residence on South Haines Creek Road in Leesburg to interview 62-year-old Martin Padilla Luna about claims of domestic battery at 11:30 a.m. Monday, according to an arrest report from the Lake County Sheriff’s Office.

Upon arrival, he saw Padilla Luna parking a white Toyota Tacoma in the driveway. The deputy asked him to step out of the vehicle and noticed signs of intoxication. These included the odor of alcohol on his breath and red, glossy eyes, the report said.

The reporting party had already advised that Padilla Luna was violent when drunk, so the deputy detained him. He repeatedly stated that he had done nothing wrong but would not give clear consent to do field sobriety exercises. This was taken as a refusal, along with his not being willing to provide a breath sample, the report said.

Additionally, the deputy found an open bottle of Hornitos tequila that was three quarters of the way empty in the backseat. There were also two BuzzBallz, one empty and one unopened, in the backseat, the report said.

A later check of Padilla Luna’s driving history showed two previous DUI convictions on Dec. 18, 2001, and June 14, 2012. He had two citations for open containers with disposition dates from June 21, 1990, and July 11, 1994. He had completed DUI school twice, as well as substance abuse treatment, the report said.

Padilla Luna was arrested on charges of DUI and refusal to submit breath test. The native of Mexico was booked at the Lake County Jail and released after posting $6,000 bond.
