A Umatilla man was arrested after trespassing at motel in Leesburg and being tased for pulling away from the officers who warned him not to return.
An officer responded to the Deluxe Motel, located at 113 N. 14th St., regarding another officer requesting urgent assistance with an individual resisting arrest that was previously trespassed around 10 p.m. Thursday, according to an arrest report from the Leesburg Police Department.
Upon arrival, the other officer was already on the ground near the front office of the motel trying to place 20-year-old Donny Ray Poole in handcuffs. The assisting officer parked his patrol vehicle and ran to help. He took handcuffs from their pouch and began to place Poole in them while the other officer used his taser and gave Poole verbal commands, the report said.
The officer placed Poole’s right hand into a handcuff and started to put the left hand in, but he continually pulled away. Once his left hand was cuffed, he still pulled away and shook his head violently. He was then told to walk toward a patrol vehicle, but he declined and had to be forcefully escorted, the report said.
When they reached the patrol vehicle, Poole had to be put against it and held in place even after being told not to resist for the search of his person. Poole was subsequently taken to the LPD for the booking process. A criminal history check at the department revealed he had not been arrested since Jan. 2024, the report said.
Additionally, Poole was trespassed from the motel on Jan. 2 at 11:10 a.m. He returned at about 5:56 p.m. and caused a disturbance with patrons. But he was not found when law enforcement arrived, the report said.
The assisting officer had also made contact with Poole that day around 8:50 p.m. at a nearby business due to him causing a disturbance. He informed Poole that he was trespassed from Deluxe Motel numerous times, and he would be arrested if he came back. Poole stated he understood he was trespassed but was returning anyway. He then left the location, walked north toward the motel and ultimately went onto the property where another officer made contact with him, the report said.
The owner of the motel provided both a verbal and sworn written statement about what he witnessed. He stated he was present when Poole was trespassed earlier in the day. Poole returned, and an officer told him to put his hands behind his back. He did not comply, instead pulling away and being taken to the ground in an effort to detain him, the report said.
Poole was charged with trespass after warning and resisting (obstructing without violence). He was transported to Lake County Jail and released after posting $2,000.
