Convicted felon caught with gun during traffic stop

A Leesburg man who spent time in prison for peddling drugs in a school zone was arrested Saturday night after police found a gun in his vehicle during a traffic stop.

Tyree Dewon Brinson, 33, was charged with possession of a firearm by a convicted felon. A criminal history search shows he was sentenced in 2012 to six years behind bars for the sale of cocaine/heroin within 1,000 feet of a school. Lake County Jail records show Brinson was also arrested in June 2019 for soliciting the sale of cocaine and unlawful use of a two-way communication device.

Shortly before 9 p.m., a Fruitland Park police officer observed a gray Dodge Charger traveling south on U.S. Highway 27/441 with the driver – later identified as Brinson – seated in a slumped, leaned-back position and not wearing a seatbelt, according to the arrest report.

The officer conducted a traffic stop and, while approaching the vehicle, immediately noticed the intense odor of marijuana emitting from within. Brinson told the officer he had a medical marijuana card, but it was not in his possession, the report said.

Asked whether there was any marijuana in the vehicle, Brinson said he recently had a tooth pulled and couldn’t smoke. He showed the officer an ashtray from the cupholder beside him, which appeared to have burnt marijuana blunts, to explain the strong smell, according to the report.

As another officer arrived at the scene, the arresting officer asked Brinson to step out of the vehicle. Initially, he hesitated and said he did not want to do so. The officer reached inside the door to unlock the vehicle and told him to step out once again, the report said.

At that point, Brinson pulled a clear plastic bag containing a green leafy substance from his pocket and admitted to having marijuana. The report noted this was not within the prescribed container.

A probable cause search of the vehicle was then conducted, and officers found a Taurus 9mm handgun in the glove compartment, within reach of Brinson. The firearm was loaded with one round in the chamber. Brinson admitted to being a convicted felon when asked, according to the report.

Brinson was placed under arrest and taken to the Lake County Jail, where he was released after posting $10,000 bond.
